Information, Consent and Risk Waiver

Approach 

Evidence based psychological therapy using a combination of CBT, Schema Focused Therapy, Emotion Focused Therapy, Equine Assisted Psychotherapy and Psychoeducation.

Setting

During our sessions we will be outside, moving around the property close to horses. Please wear appropriate sturdy boots, practical clothes, rainwear (excluding umbrella) and sunscreen where indicated.

Bad weather policy

On occasions bad weather may prevent the sessions from proceeding and in that case you will be notified via sms and an alternative time will be scheduled.

Sessions

Sessions run for 50 -60 minutes. The first and possibly second sessions may be room or screen based and involve information collection, assessment and development of therapeutic goals in a collaboration with you.Subsequent sessions occur in the paddock and can involve the horses and or chickens and sometimes play. It is a learn/discover/grow through action, emotions and thoughts approach. These sessions do not involve horse riding. Led mounted sessions may occur as indicated and agreed. In our approach horses are regarded as autonomous sentient beings with their own needs and choices and the horses are included in sessions in a way that respects this. Horses help to model for us clear boundaries (yes/no), help us navigate and clarify our needs, values and unhelpful patterns and assist us in the creation of new more adaptive ways of moving through life and relationships.

Confidentiality

All information shared remains confidential unless it is disclosed that a person or people are at risk and if so appropriate action will be taken in consultation with you. Risks include physical or emotional harm to self or other for which I am legally mandated to report.

Boundaries

Engaging with you as a psychologist prohibits any other type of relationship developing between us in future. Please be aware that you can engage with us via social media but the contents of our sessions will be off limits to protect your privacy.

Fees

Session fees are due at the time of the session via direct bank transfer to bsb  062193 Account No 1038 2541 or cash.

Cancellation

At least 72 hours notice is required for change/cancelation of appointments without a cancelation fee applying. Less than 24 hours notice will attract the full fee and 24-72 hours will attract half the session fee. Medicare does not provide a rebate for cancelations.

Equine Activities

An equine ‘activity’ or ‘equine experience’ includes but is not limited to the following:-observing, grooming, haltering, leading, riding and participating in equine assisted therapy of any kind.

Risks

Numerous risks are present when being around horses, despite all safety precautions. If a client falls from a horse this may result in injury. If a horse is frightened or provoked it may divert from it’s training and exercises and act according to it’s natural instincts. These risks exist for any person spending time around a horse/s.

Here you acknowledge responsibility for your own safety and the safety of those in your care. You agree to not participate in any activity unless you are confident that you can do so safely. Participation in equine activities constitutes a voluntary assumption of all the risks associated with equine activities involving us or being present on the property at 5972 Ilford Sofala Road, Ilford, NSW, 2850.

Helmet use

Wearing a properly fitting and secured helmet whilst riding, mounting, dismounting and being near horses may reduce the severity of head injuries as the result of a fall or other occurrence. Helmet use is compulsory for any mounted sessions.

Apportionment of liability

In consideration of you being allowed to attend, participate in or observe activities conducted by us, or be present at the property on which we conduct these activities, you agree to hold harmless and release our employees, representatives, others acting on our behalf, and the owners of any horse or other property used by us, from all claims, demands, causes of actions and legal liability, whether the same be know or unknown, anticipated or unanticipated, even if due to negligence and/or acts or omissions of our other clients. You further agree to waive all rights which may otherwise arise from an injury to you or your property, and shall not bring any claims, demands, legal actions or causes of action against us, those persons described above, or any person or entity, for any economic or non economic loss due to bodily injury, death or property damage arising out of the activities of us or your presence on or proximity to property used by us.

Indemnity

You agree to be responsible for any and all damages, injury, loss of life caused by you or a horse in the care, custody and control of you, and to indemnify us, for any losses or expenses (including legal costs) which we incur in connection with claims by you.

Safety Rules

You agree to follow our directions, including rules for safety as are from time to time provided to you, or posted by us. You acknowledge that failure to follow our safety rules or the directions of us or our staff may put you at risk or increase your risk of personal injury.

Exclusion, restriction, or modification of rights under the Australian Consumer Law (Commonwealth):

Under the Australian Consumer Law (CTH), statutory guarantees apply to the supply of certain goods and services, including recreational activities. It is possible for a supplier to ask you to agree that these statutory guarantees do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier because services provided were not in accordance with the guarantees are excluded, restricted or modified as set out below. By signing below/ticking the box agreeing to these terms and conditions you agree that our liability for:

-physical or mental injury (including death, the aggravation, acceleration or recurrence of such an injury)

-the contraction, aggravation or acceleration of disease;

-the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs: that is or may be harmful or disadvantageous to you or the community, that may result in harm or disadvantage to you or the community, that may be suffered by you (or a person for whom or on whose behalf you are acquiring the services) resulting from the supply of our services is excluded.

The benefits of this agreement, including the release of legal liability, waiver of right, indemnity and covenant not to sue, are intended to benefit our employees, representatives, insurers, and all other acting on our behalf and the owners of any horses or other property used by us.

This agreement shall be binding upon us, client, client’s heirs and estate, when signed/agreed to by the parties. If any clause, phrase or work is in conflict with the law in New South Wales (NSW) or is unenforceable for any reason then that single part is null and void. This agreement will be governed by and will be construed according to the laws of NSW
